Fees & Payment Schedule
All payments are due no later than seven days after receipt of invoice, unless otherwise agreed.
We’re sure you understand how important for us as a small business it is that you pay the invoices that we send you promptly. So, you kindly agree to stick tight to agreed payment schedules and pay within the requested period.
Deposits are non-refundable except in limited circumstances. Please see Termination for more details.
Interest on Late Payments
Bridget Designs reserves the right to claim interest as compensation for late payments over seven days from the due date of any invoice (apart from deposits), at 5% of the outstanding invoice balance, per day until the balance is paid.
* Changes And Revisions
The price quoted above is for the agreed size and scope of this project. However, things can change, and we are happy to be flexible. If you want to make changes to the brief or additions during the project, we will provide a separate quote for any additional work required.
Content
Website Copy
Bridget Designs is not responsible for writing any text copy unless you hire the services of our recommended copywriter, in which case you will liaise with them regarding the content. Likewise, we are not responsible for correcting spelling, grammatical or other errors in your website copy, either before or after inclusion on the website.
Please ensure that your text is error free and exactly as you want it to appear before giving it to us for inclusion on the website, as we are not required to proof-read it first or after. If you would like to have copy written or help with revising or proofreading your content, our recommended copywriter will be happy to help, please ask for details.
Images and Photographs
Please provide photographs in a high-resolution digital format and graphic files such as logos in an editable vector format such as .eps, .ai or editable .pdf. We can advise you on the best format and sizes to use. If you wish to use stock photography, we can recommend stock libraries. For best results we suggest using a professional photographer and if needed we can recommend one for you.
We include up to five stock images as part of the project, if required. If further stock images are needed, then they are charged at £5 per image after that, chargeable at the end of the project.
All images must be owned by you, or you must have obtained permission to use them.
Adding Content to the Website
We will include content provided by you on the website as part of the project, but please note the website project will be considered complete, and payment due once the design and coding is completed, even if the content is not ready. Should you not be able to provide the necessary content by the dates requested payment for the website will still be due on the dates agreed.
In the case of large portfolios or online shops with lots of products, we will add up to ten items, and then provide information on how to include the remained yourself unless otherwise agreed.
You agree to provide content in a timely fashion and by the dates agreed. Any content not provided within 30 days of the final payment will be added to the site at our hourly rate of £50 per hour if you want us to add it for you, or by our support team if you take out a suitable support package at the end of the project.
Going Live
Bridget Designs will keep websites on our development server for up to 30 days following the final payment on the site. Should you not be ready to go live after that period is up, we will provide you with a backup of the files as we are no required to keep a copy after that date.
Should you wish us to assist with making the site live after that date, an additional fee of £100 will be payable to reinstate the project and make the site live. Otherwise, this process is included in the project fee.
Browser Testing
All our websites are fully responsive and tested to work across a range of modern devices.
However, browser testing no longer means attempting to make a website look the same in browsers of different capabilities or on devices with different size screens. It does mean ensuring that a person’s experience of a design should be appropriate to the capabilities of a browser or device.
We test our websites in the latest two versions of the following major desktop browsers: Safari (Mac), Chrome, Edge (Microsoft) and Mozilla Firefox.
Although our sites are coded to degrade well, we do not specifically code for, or test websites in older versions of these browsers. If you require support for these or any browser or operating system not listed, we can provide a separate quote for that.
We also test our websites for mobile support on IOS Safari and Android Chrome and Firefox latest versions. If you need your website to be tested in a mobile browser or device not listed let us know and we can provide a separate estimate for that.
Assignment of Work
We reserve the right to assign work to other suitable industry professionals to support and enhance your project and to use third party WordPress plugins if deemed necessary for the project ensure quality and on-time completion. This will be agreed with the client before work commences, however.
Timescales
Any timescale provided by Bridget Designs should be considered an estimate. Bridget Designs cannot be held liable or responsible for any project over runs, whatever the reason. Estimated project duration is from the date that the deposit fee is received and the contract signed unless agreed otherwise.
We always work to ensure we both start and complete projects within the agreed timescales wherever possible. However, projects often change and grow during development, or unforeseen complications or changes can arise. Therefore, it is not always possible to accurately predict how long a project will take, so in some cases projects may take longer than originally agreed or start later than planned.
If this is the case, we will do our best to notify you of any changes to start dates or completion dates as early as possible and Bridget designs will not be liable for any damages, including lost profits, lost savings or other incidental, consequential or special damages, or provide any refunds or compensation as a result of this.
We reserve the right to move the agreed start or completion dates if necessary due to unforeseen circumstances. We will aim to give as much notice as possible should this be necessary, and Bridget Designs is not liable for any lost profits, saving or other incidental, consequential, or special damages arising from any delay should this be the case.
Copyright
We build bespoke, custom websites using the WordPress platform. All WordPress source code is licensed under the General Public License. All code created by Bridget Designs remains copyright to Bridget Designs as this code is proprietary.
You’ll own the visual elements that we create for this project. If requested, we will give you source files and finished files and you should keep them somewhere safe as we’re not required to keep a copy (although we do keep a copy for all on going clients). You own all elements of text, images and data you provided, unless someone else owns them.
We’ll own the unique combination of these elements that constitutes a complete design and once the site is launched and full payment has been made, we’ll license that you, royalty free, exclusively and in perpetuity for this project only, unless we agree otherwise. We can provide a separate estimate for that if requested.
All web design projects will contain a copyright/legal statement detailing that copyright lies with the respective owner of the website and will contain a discrete link to Bridget Designs’ website in the footer unless otherwise agreed.
Non-payment for services rendered forfeit all client rights under any agreement with Bridget Designs.
You guarantee that any elements of text, graphics, photos, designs, trademarks, or other artwork given to us for inclusion on the website are owned by you, or that you have permission from the rightful owner to use each of these elements.
Liability And Guarantee
Due to the nature of web design, we can’t guarantee that our work will be completely error-free and so we can’t be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages for these, even if you’ve advised us of them.
Likewise, it is not possible to guarantee the website against any future updates to WordPress core files or third-party plugin files and Bridget Designs is not liable or responsible should any part of the website cease to function as expected due to a WordPress core or plugin release after the website has gone live.
Plugins And Future Updates
Your website will be a custom, bespoke theme for WordPress. The core files that run the WordPress admin are constantly being updated and developed to ensure users benefit from the latest in coding developments, functionality, and security.
All our websites are coded to meet the latest WordPress coding standards at the time of release and will come with the latest version installed. It is the responsibility of the user to ensure that all WordPress plugins and core files are kept up to date and Bridget Designs accepts no responsibility for any functionality or security issues with the site should this not be maintained.
Where third party plugins are necessary to complete a website project, we will take every care to choose reputable, quality plugins. However, Bridget Designs is not liable should any third-party plugin cease to function as expected or become obsolete following a core update to WordPress or other update. We will attempt to find a suitable fix or replacement in that eventuality, there may be an additional fee for this following the 30-day guarantee period (see below).
If the project plan includes premium plugins, then the client is responsible for any fees involved, both for the project and ongoing if they wish to renew.
30 Day Review Period
Once the site has gone live you have 30 days to review the site and if there are any errors arising from our code we will fix or change that without question and free of charge. After the 30-day period, maintenance tasks and bug fixes are covered by our Essentials or Managed support plan should you wish to take one out, otherwise will be charged at £50 per hour, minimum 1 hour.
Future development work, updates or other content or design changes will be charged at the same rate. For large project we will send a separate quote.
We are not able to provide regular ad hoc support for any website following the 30-day period and we recommend taking out a support plan if you will need regular support (especially for ecommerce websites).
If you would like to make any changes or updates that were not included in the original project at any time, or errors arise from plugin updates, work done to the site following the go live date, by yourselves or other third parties, or anything other than our code (see above), that would carry an additional charge and would be subject to availability.
Data Protection
The client agrees that Bridget Designs may store all relevant information about the client required to complete the project and that that information may be kept on file for the purposes for support and maintenance in the future, unless the Client specifically requests us to remove it.
Bridget Designs agrees that all personal and sensitive data will be kept securely and managed in accordance with GDPR. For more information please see the Privacy Policy on our website at www.bridgetdesigns.co.uk/privacy-policy
Termination
You’ll have the opportunity to review our work and provide feedback where appropriate during the project. If, at any stage, you’re not happy with the direction our work is taking, you have the right to cancel at any time. Should you cancel, then the deposit is non-refundable at any stage, to cover loss of earnings, planning and preparation time and any work completed up to that point. Should this not cover the work we have already completed for you at the point of termination, you’ll pay us in full for everything we’ve produced until that point over and above the deposit amount, according to the payment schedule above and the contract will then be terminated. This is non-negotiable.
In the extremely unlikely event that Bridget Designs needs to cancel the project due to force majeure before the site has been fully built and the deposit payment does not cover work already completed, then we will agree a partial refund of up to a maximum of 50% of the deposit with the client, depending on the work completed to that point.
Any work produced by Bridget Designs up to that point, in either case, would then remain the property of Bridget Designs. You understand that you cannot claim any additional expenses, damages, or claims based on the failure of Bridget Designs to complete the project due to illness, personal reasons or acts of God and that this agreement is automatically terminated on the death of Bridget Designs.
Legal Disclaimer
These Terms and Conditions, and the relationship between You and Us (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England & Wales.
